General Terms and Conditions for Online Sales

1. PREAMBLE

These Terms and Conditions are agreed upon between Love to Spend Unip. Lda., with headquarters at R. Simão Bolivar 311, room 2, 4470-214 Maia, NIPC 510322425, hereinafter referred to as SITE, and the individuals or consumers, hereinafter referred to as CONSUMER, who use its SITE, https://flenia.com, to browse or make online purchases. The use of the SITE implies acceptance of the terms set forth here. The CONSUMER agrees to follow the instructions provided on the SITE to ensure a secure shopping experience in compliance with these Terms and Conditions.

2. OBJECT

These Terms and Conditions aim to regulate the access and use of the website https://flenia.com, as well as the conditions applicable to the purchase of physical products offered by the SITE.
The products are sold exclusively for the personal use of the CONSUMER.

3. INFORMATION ABOUT PRODUCTS

The products available on the SITE are described with the greatest possible accuracy, including images, specifications, and prices. However, the SITE reserves the right to modify or discontinue products and services without prior notice, committing to inform the CONSUMER in the event of changes after the purchase.

4. PRICES AND PAYMENT CONDITIONS

4.1. The prices presented include VAT at the applicable legal rate. When applicable, the cost of delivery or shipping will be stated separately.
4.2. Payment can be made through the following methods:

• Credit Card
• PayPal
4.3. Financial transactions are carried out using secure technologies and comply with PCI-DSS standards for financial data protection.
4.4. In the event of an evident pricing error, the SITE will notify the CONSUMER, and may cancel the order and refund the amount paid.

5. RIGHT OF WITHDRAWAL

5.1. Under Decree-Law No. 24/2014, of February 14, the CONSUMER may withdraw from the contract within 14 days from the date of receipt of the product, without needing to provide a reason. To exercise the right of withdrawal, the CONSUMER must return the product in its original packaging and without signs of use.
5.2. The return shipping costs will be the responsibility of the CONSUMER, unless the product is defective or has been sent by mistake.

6. CONSUMER'S OBLIGATIONS

6.1. Provide true and complete information during the registration and purchase process.
6.2. Use the purchased products solely for personal purposes, with resale or commercial use prohibited without the express authorization of the SITE.

7. INTELLECTUAL PROPERTY AND USE OF PRODUCTS

All content on the SITE, including texts, images, logos, and videos, is protected by copyright and intellectual property rights. Reproduction, distribution, or unauthorized use of such content is prohibited.

8. COMPLIANCE WARRANTY

The products sold come with a 3-year compliance warranty, in accordance with applicable legislation, starting from the date of delivery. If the product is defective or does not meet the descriptions on the SITE, the CONSUMER may request repair, replacement, or refund of the product.

9. PERSONAL DATA PROTECTION

The CONSUMER'S personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and used solely for managing purchases, personalizing services, and promotional communications, with consent. 10. LIMITATION OF LIABILITY

The SITE is not responsible for any direct or indirect damages resulting from the use of the website or purchased products, including but not limited to damages caused by computer viruses or technical failures beyond its control.

11. DISPUTE RESOLUTION

11.1. Any conflict or disagreement should be submitted to the competent Portuguese Court.
11.2. Consumers have the option to resort to official alternative dispute resolution entities (ADR) that assist in the mediation or resolution of conflicts before initiating legal proceedings. The coverage of these entities is limited to municipalities that are members, namely:

12. CHANGES TO THE TERMS

The SITE reserves the right to amend these Terms and Conditions, recommending that the CONSUMER review them periodically.
